Testing of devices is subject to the following regulations:
- the Act of August 30th 2002 on Compatibility Assessment System
(Journal of Laws, No. 166, 2002, item 1360 with subsequent amendments);
- the Act of July 16th 2004 Telecommunications Law
(Journal of Laws No. 171, 2004, item 1800);
- Ordinance of the Minister of Infrastructure of April 15th 2004
"on assessment of conformity of telecommunications terminal devices
to be used as terminals in public networks and radio devices to essential
requirements and their markings" (Journal of Laws No. 73, 2004, item 659).
Following entry into force of new regulations, introducing, among other changes,
the provisions of Directive 1999/5/EC into Polish legislation, it became mandatory
to obtain a favorable assessment of conformity of telecommunications terminal devices
and radio devices to essential technical requirements before introduction into trading.
If essential requirements are satisfied, a party introducing the product into trading
labels it with a CE mark and issues a declaration of conformity.
Conformity evaluation is required for all devices being introduced into trading, which
may be harmful to humans or the environment, in particular devices covered by the Ordinance
of the Minister of Infrastructure of April 15th 2004 .on assessment of conformity of
telecommunications terminal devices to be used as terminals in public networks and radio
devices to essential requirements and their markings".
Devices listed in this Ordinance are divided into two main groups:
- Class 1 devices (telecommunication terminals and certain radio devices), whose
assessment of conformity to essential technical requirements can be performed without
participation of notified test house;
- Class 2 radio devices, whose assessment of conformity to essential technical
requirements must be performed with participation of notified test house.
In both cases, the product conforming to essential technical requirements must
be labeled with the CE mark, and the party introducing such product into trading
shall issue a declaration of conformity.
